Terms of Service

These Terms of Service ("Terms") govern your access to and use of QR-Restaurant (the "Service"), a QR-code and progressive web app (PWA) based digital menu and ordering platform for restaurants, operated by WebPlaza.pk ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

QR-Restaurant allows restaurants ("Restaurant Owners") to create a digital menu accessible via a QR code, receive and manage orders placed by their customers ("Customers"), and track order status in real time. Customers may place orders as guests, without creating an account. QR-Restaurant does not process online payments; orders are settled directly between the Customer and the Restaurant through the Restaurant's own payment/delivery arrangements.

2. Accounts

Restaurant Owners must register for an account to manage their menu, orders, and restaurant settings. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Customers are not required to create an account to place an order.

3. Restaurant Owner Responsibilities

Restaurant Owners are solely responsible for the accuracy of their menu content (including prices, descriptions, and images), fulfilling orders received through the Service, complying with all applicable food safety, consumer protection, and tax laws in Pakistan, and all communication with their Customers, including via the WhatsApp contact feature. QR-Restaurant is a technology platform only and is not a party to any transaction between a Restaurant Owner and a Customer.

4. Subscription and Fees

Access to the Service for Restaurant Owners may be subject to a fixed subscription fee, billed in Pakistani Rupees (PKR), as communicated at the time of signup. QR-Restaurant does not charge commission on individual orders. Subscription terms, including any free trial or pilot period, will be disclosed separately and may be updated with reasonable notice.

5. Acceptable Use

You agree not to use the Service to upload unlawful, fraudulent, or misleading content, to interfere with or disrupt the Service or its infrastructure, or to attempt to gain unauthorized access to any account, data, or system not belonging to you.

6. Intellectual Property

The Service, including its design, software, and branding, is the property of WebPlaza.pk and is protected by applicable intellectual property laws. Restaurant Owners retain ownership of the menu content, images, and business data they upload, and grant us a limited license to display and process that content solely to operate the Service on their behalf.

7. Third-Party Services

The Service integrates with third-party tools such as WhatsApp for communication between Customers and Restaurant Owners, and Supabase for data storage and authentication. Your use of these third-party services is subject to their own terms and privacy policies, over which we have no control.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, WebPlaza.pk shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including but not limited to loss of revenue, orders, or data. Our total liability for any claim arising from these Terms shall not exceed the subscription fees paid by the affected Restaurant Owner in the three (3) months preceding the claim.

10. Termination

We may suspend or terminate a Restaurant Owner's access to the Service at any time for violation of these Terms, non-payment of applicable fees, or misuse of the platform. Restaurant Owners may stop using the Service and request account closure at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated where reasonably practicable.

12. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
